Introduction
Welcome to mycarpair.com (the “CarPair Site”), a website owned and operated by CarPair LLC, its parent and/or subsidiaries (“CarPair,” “we,” “our,” or “us”). These Terms of Service (“Terms”) describe the terms and conditions that govern your use of and participation in our services, including the CarPair Site, our online and/or mobile services, and our related software provided on or in connection with the service (collectively, the “CarPair Service”). For the purposes of these Terms, “you” means each person using the CarPair Service. All visitors, users, and others who access the Site and/or Service, including you and any persons that you authorized to use your account, may be referred to in these Terms as the “User.” PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. BY ACCESSING OR USING THE CARPAIR SERVICE OR BY REGISTERING FOR AN ACCOUNT ON THE CARPAIR SITE, YOU AGREE TO BE BOUND BY THESE TERMS, AS AMENDED FROM TIME TO TIME, AND TO THE COLLECTION AND USE OF YOUR INFORMATION AS SET FORTH IN THE CARPAIR PRIVACY POLICY, WHICH IS HEREBY INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM USING OR ACCESSING THE CARPAIR SITE OR THE CARPAIR SERVICE.
Acceptance and Changes
These Terms may be modified from time to time; the date of the most recent revisions will appear on this page, so check back often. Continued access of the CarPair Service by you will constitute your acceptance of any changes or revisions to these Terms. If you breach, violate, fail to follow, or act inconsistently with the rules, restrictions, limitations, terms and/or conditions that apply to the CarPair Service, whether listed in these Terms, our Privacy Policy, posted at various points in the CarPair Service, or otherwise communicated to users of the CarPair Service (collectively, the “Agreement”), we may terminate, discontinue, suspend, and/or restrict your account/profile, your ability to access, visit, and/or use the CarPair Service or any portion thereof, and/or the Agreement, including without limitation any of our purported obligations hereunder, with or without notice, in addition to our other remedies.
Connecting Car Sellers and Buyers
CarPair connects those offering cars for sale (“Sellers”) and those looking to acquire cars (“Buyers”). The Services act as a meeting place only; the actual contract for sale for each car listed on the Services is directly between the Seller and the winning Buyer. When we use the word “you” in these Terms, it refers to any user, regardless of whether he or she is a Seller, Buyer, other registered user or unregistered user, while if we use one of those specific terms, it only applies to that category of user. Before acquiring a car from any Seller (each, a “Seller Car”), Buyers are responsible for making their own determinations that the Seller Car is suitable. CarPair is only responsible for connecting Sellers and Buyers and cannot and will not be responsible for making sure that any Seller Car is up to a certain standard of quality. CarPair similarly cannot and will not be responsible for ensuring that information (including credentials) any Buyer or Seller provides about himself or herself or about any Seller Car he or she is offering is accurate or up-to-date. Each Seller acknowledges and agrees that they shall make reasonable efforts to complete the sale of their Seller Car if there is a winning bid. Each Buyer acknowledges and agrees that if they are the winning Buyer in an listing through the Services, their bid is binding on the Buyer and the Buyer is responsible for all applicable government fees and taxes for the vehicle won through such bid. Additionally, Buyers may be responsible for other costs associated with the purchase, including but not limited to registration fees, title fees, and any other fees required by law.
Responsibilities and Liabilities
CarPair does not directly offer the Seller Cars. You hereby acknowledge that CarPair does not supervise, direct, control or monitor the Seller Cars and expressly disclaims any responsibility and liability for the Seller Cars, including but not limited to any warranty or condition of quality or fitness for a particular purpose, or compliance with any law, regulation, or code. Sellers may not remove a car made available for listing on the Services before the end of such listing. While a Seller Car is listed on the Services, Seller may not list or make available such Seller Car on any other listing, dealership, listing service or publication.
Monitoring and Complaints
We may monitor activity on the CarPair Site to ensure compliance with these Terms. You hereby specifically agree to such monitoring. Nevertheless, we do not make any representations, warranties or guarantees that: (1) the CarPair Service, or any portion thereof, will be monitored for accuracy or unacceptable use, or (2) we will take any specific action (or any action at all) in the event of a challenge or dispute regarding compliance or non-compliance with the Agreement.
What to Do if You Have a Complaint About the CarPair Site and the Content
- Copyright Complaints: If you have reason to believe that your Content has been copied and/or is accessible on the CarPair Site in a way that constitutes copyright infringement, or that the CarPair Site contains links or other references to another site, application, destination or service that contains Content or activity that infringes your copyright rights, you may notify us at Info@mycarpair.com.
- CyberCrime: If you have reason to believe you may be the victim of an online crime, such as identity theft, fraud, infringement, or hacking, you may contact the Internet Crime Complaint Center, at www.ic3.gov, a partnership between the Federal Bureau of Investigation (FBI), the National White Collar Crime Center (NW3C), and the Bureau of Justice Assistance (BJA).
Registration and Account/Profile Creation
We may at times require that you register and/or set up an account/profile to access, visit and/or use portions of the CarPair Service, or the CarPair Site as a whole. You may be provided, or required to choose, a password and/or User ID, and you may provide a credit, debit, or charge card number, or other payment information, as well as your name, telephone number(s), email and/or street address, and other personally identifiable information. All such information shall be referred to in the Agreement as your “Registration Information”. You agree, represent, warrant, and guarantee that all Registration Information provided by you is true, accurate, complete, up-to-date, and solely yours. You may not impersonate, imitate or pretend to be somebody else when registering and/or setting up an account/profile on the CarPair Site. If any of your Registration Information changes, you must update it promptly by using the mechanism or contact information on the CarPair Site that allows you to change or update your Registration Information, if available. If no such mechanism or contact information is available on the CarPair Site, please notify us as described in our Privacy Policy.
Rules of Usage
- Age Restriction: The CarPair Service is not intended for users under the age of 16, and we do not knowingly collect personally identifiable information from users under the age of 16.
- Equipment Compatibility: You shall ensure that all equipment, hardware, software, products and/or services you use to access, visit, or use the website does not disturb or interfere with our operation of the CarPair Service, or impede or interfere with others’ access, visitation and/or use of the CarPair Service.
- Personal Use: Unless otherwise specified, the CarPair Service is intended for your personal, non-commercial use only.
- Compliance with Laws: You must comply with all applicable import and export control laws, rules, and regulations of the United States and other countries.
- Intellectual Property: Content that is provided by us, our licensors, vendors and/or service providers is protected by local, state, federal, provincial, national, international, and foreign copyright, trademark and other intellectual property laws, rules, and regulations.
Content Usage
Content made available for download or streaming is subject to the same terms, conditions, limitations and restrictions applicable to all Content Provided by us, our licensors, vendors and/or service providers. You must use such Content only as authorized.
Fees and Costs
- Buyer Fees and Taxes: Buyers are responsible for all applicable government fees and taxes for the vehicle won through the listing. Additionally, Buyers may incur other costs associated with the purchase, such as registration fees, title fees, and any other fees required by law. These costs are the sole responsibility of the Buyer and are not included in the listing price of the vehicle.
- Payment Processing: You may be required to provide a credit, debit, or charge card number, or other payment information for transactions, including purchases and/or registration for additional products and/or services.
Dispute Resolution
In the event of any conflict or inconsistency between these Terms, our Privacy Policy, and any rules, restrictions, limitations, terms and/or conditions that may be posted at various points on the CarPair Site or otherwise communicated to users of the CarPair Service, these Terms and Privacy Policy shall control.

By using the CarPair Service, you acknowledge and agree to these Terms and the CarPair Privacy Policy. If you do not agree, you are prohibited from using or accessing the CarPair Site or the CarPair Service.
Additional Provisions
- Monitoring and Enforcement: We reserve the right, in addition to our other remedies, to take any technical, legal, and/or other action(s) that we deem necessary and/or appropriate, with or without notice, to prevent violations and enforce the Agreement and remediate any purported violations.
- Account Security: You are solely responsible for maintaining the confidentiality of your Registration Information. You may not authorize or permit anyone else to access and/or use your Registration Information, or access, visit and/or use the CarPair Site by use of your account/profile and/or Registration Information.
- Intellectual Property Rights: Content provided by us, our licensors, vendors and/or service providers is protected by intellectual property laws. You must comply with these laws and not infringe on the rights of the content owners.
By using the CarPair Service, you acknowledge and agree to these Terms and the CarPair Privacy Policy. If you do not agree, you are prohibited from using or accessing the CarPair Site or the CarPair Service.
